1. Acceptance of Terms

By accessing or using ThundaHire ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

ThundaHire is a one-way video interview platform that allows employers to create interview questions, invite candidates via unique links, and review recorded video responses. Candidates record answers directly in their browser without needing an account.

3. Accounts

To use ThundaHire as an employer, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate and complete information when creating your account and keep it up to date.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload or share content that is harmful, offensive, or violates the rights of others
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to discriminate against candidates on the basis of race, gender, age, disability, or any other protected characteristic
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated systems to access the Service without our written permission

5. Candidate Data & Consent

As an employer, you are responsible for ensuring that candidates are informed about the video interview process and consent to having their responses recorded. ThundaHire provides candidates with clear information on the interview page before they begin recording.

You agree to use candidate data (including video recordings) solely for the purpose of evaluating their suitability for the role and in compliance with applicable data protection laws.

6. Subscriptions & Billing

ThundaHire offers Free, Pro, and Enterprise plans. Paid plans are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis.

You may cancel your subscription at any time from your account Settings page. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.

7. Content Ownership

Your content: You retain ownership of all content you upload or create on ThundaHire, including job postings, questions, and notes. You grant us a limited licence to store and display this content as necessary to provide the Service.

Candidate content: Video recordings belong to the candidate. You are granted access to view and evaluate recordings for hiring purposes only.

Our content: The ThundaHire platform, including its design, code, and branding, is owned by ThundaHire and protected by intellectual property laws.

8. Data Retention

Video recordings are retained according to your plan: 30 days (Free), 1 year (Pro), or unlimited (Enterprise). When a retention period expires or when you delete a job, associated videos are permanently removed from our storage.

You may request deletion of your account and all associated data at any time by contacting us.

9. Service Availability

We strive to keep ThundaHire available at all times, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages beyond our control. We are not liable for any loss resulting from service downtime.

10. Limitation of Liability

To the maximum extent permitted by law, ThundaHire shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data after a reasonable retention period.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
